Jose Baez, Casey Anthony’s defense attorney, gave an almost embarrassing performance in court today… he stumbled around his point, said uh repeatedly, didn’t cite proper case law, was vague about his reasoning and the judge seemed to actually take pity and had to help him out a couple of times. But some of the motions were valid, some were moot (had already been granted) and others were granted w/some stipulation. It was (somewhat) shocking to me that Jose was not better prepared and it makes me worry that if/when Casey is eventually convicted there’s a chance it can be overturned for (incompetent) ineffective counsel.

Judge Strickland granted:
*Demand For Discovery And Inspection Relating to Digital Forensic Evidence -Jose kept saying digital photographs of the hard drives- idiot. I think they already had access to this info- he just again wants the state to do his work- show him what they think is important. He has the actual computers back.
*Motion To Inspect, Test And Photograph Evidence Held By The State Of Florida -They must coordinate a time to inspect the car. I wonder if Casey gets to go? I’m sure she’s dying to- she must have thought she thoroughly cleaned that car. State must present DNA, air samples, hair strands and chloroform found in trunk info within the next 10 days. DENIES- request about cadaver dogs- that is clearly not related to neglect case.
*Motion To Compel Department Of Children And Family Records -I think this will be granted but he has to re-file- will only have access to certain things re- confidentiality.
*Demand For Discovery And Inspection Relating To Polygraphs -some weird arguing here bc they aren’t allowed in court but basically the state has already given them what they wanted and has no problem allowing them to depose people who administered the polygraphs.
*Motion To Compel Flight Manifest -there was a tip (that’s been ruled out by LE) that Caylee was spotted on this flight. I think the entire basis of his defense seems to be- he’s going to whine about how they didn’t track down every single tiny tip that Cindy Anthony called in- he’s going to say- they never looked for an alive Caylee. I think he’s wrong about that and will be surprised at the breadth and depth of their investigation.
*Motion To Compel For Evidence Related To Any Zenaida Gonzalez -Jose really fumbled here- he hasn’t even availed himself of what they’ve made available so far and basically it seems he wants the state to do his investigation- the judge said do your own legwork- ha ha! Wonder what they’re going to do w/all the ZG info. The state even referred once to “the phantom” Zenaida
These motions were tabled, to be ruled on later today or early next week:
*Motion To Compel Results Of Forensic Testing -this was some convoluted arguing over whether the car samples are related to the child neglect case or the potential homicide case. Also, there is concern over small samples and availability for defense to have enough sample left to test themselves. Baez wants defense to be able to test when there’s enough and when there’s not, he wants to be present for testing or have access. Had Nancy Grace’s friend Dr. Kobi call in on the phone- it was annoying and hard to hear. That seems reasonable and I think will be granted but it does depend on the technical legalities of which case it pertains too- hopefully the state will file homicide charges soon and it will be a moot point. I want her to be granted exactly what the law allows- I don’t want there to be any grounds for appeal!
*Motion For Allowing Defendant To Travel To Places Of Interest -the bail bonds man responsible for posting Casey’s $500,000 bail allowing her to be out of jail right now, said he has no problem w/her traveling to points of interest in the case, he would go w/her and doesn’t believe she’s a flight risk. Casey’s case manager Hughes, said she’s been requesting additional time the past 2 days, says Casey has always followed the rules and has not tested positive for drugs. She needs to know where Casey is at anytime throughout the day. Says she’s never had someone ask to see their attorney for 6 hours a day. Obviously Jose needs more time away from Casey- so that he can be better prepared for his next court appearance. The state says its basically just a request to get off of home confinement- its too vague. I agree. She had a month to look for her daughter- I can’t see what value visiting locations she pointed out to police would bring to the case.
*Motion To Seal -Jose says there’s an imminent security risk when her comings and goings are made public. The state says Jose needs to come up w/a specific exception to the public records law.
Casey was supposed to be there but she wasn’t. Perhaps she was preparing her aspect of the case– whining about media coverage. Did you see that picture of her going into Jose’s office w/that huge binder the other day? It was the first time I can recall seeing her w/out her FIND CAYLEE shirt- just a tight blue button down, shorts, those huge, ugly, stolen, white glasses and a big 4-5 inch white binder w/the letters MEDIA COVERAGE clearly marked on the outside- it kind of looked like she was holding it so the photographer could see it. I will look for it later and try to post.
BTW don’t you think if that was your client and several major news media were regularly playing footage of your client basically STEALING those UGLY WHITE SUNGLASSES by forging a stolen check from a friend- you might advise her not to wear them? AND- What happened to the WHERE’S CAYLEE T-SHIRT?
